Prices of products are correct at the time of entering information, however, we reserve the right to change prices without prior notice (although we will inform you if any such price change affects your order).

For the avoidance of doubt, no contract will exist between you and Special Source Ltd for the sale by Special Source Ltd to you of any product unless and until Special Source Ltd sends you an e-mail confirming that it has dispatched your product.

Cancellation

Force Majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by a force majeure event. A force majeure event which means any act or event beyond our reasonable control such as, but not limited to, strikes or industrial action by third parties (but not those caused by Special Source Ltd’s own employees), civil commotion, riot, invasion, terrorist attacks, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster (“Event”).

If an Event takes place that affects the performance of our obligations under a contract:

(a) we will contact you as soon as reasonably possible to notify you; and

(b) our obligations under a contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event. Where the Event affects our delivery of products to you, we will arrange a new delivery date with you after the Event is over.

You may cancel a contract affected by an Event . To cancel please contact our customer services team. If you opt to cancel, you will have to return (at our cost) any relevant products you have already received and we will refund the price you have paid, including any delivery charges.

Additional terms

We may transfer our rights and obligations under a contract to another organisation, but this will not affect your rights or our obligations under these Terms.

You may only transfer your rights or your obligations under these Terms to another person if Special Source Ltd agrees in writing.

These Terms are agreed between you and us. No other person shall have any rights to enforce any of its Terms.

Each of the clauses within these Terms operates separately. If any court or relevant authority decides that any of the clauses are unlawful or unenforceable, then the remaining paragraphs will remain in full force and effect.

The failure or delay of Special Source Ltd to exercise any right, power or remedy provided under these Terms or otherwise available in respect hereof at law or in equity shall not constitute a waiver by Special Source Ltd of its right to exercise any such or other right, power or remedy or to demand such compliance, or you of your obligations under these Terms. In the event we do waive a default we will do so in writing on a case by case basis.

Competition Terms and Conditions

  1. Promoter
    The promoter of this competition is Aquaplanet Sports, located at Brewery, Toll Bridge Rd, Bath BA1 7DE.

  2. Eligibility
    This competition is open to residents of the UK aged 18 years or older. Employees of Aquaplanet Sports, their immediate family members, and anyone directly connected to the competition are not eligible to enter. Must live in the UK as orders can only be shipped to the UK. 

  3. How to Enter

    • Online Entry: Participants may purchase tickets for £3 each via our website. Multiple entries are allowed, with each additional ticket increasing the chances of winning.
    • Postal Entry: To enter for free via post, please send a postcard with the following details:
      • Name of the competition: ISOBATH + PACE 10'6". What material is a paddle board made from?
      • Answer to the competition question: 
      • Full name
      • Email address
      • Mobile number
        Postal entries must be sent to Brewery, Toll Bridge Rd, Bath BA1 7DE and received before the deadline. Only one postal entry per person is allowed.
  4. Competition Period
    The competition opens on 13th December and closes at 11:59pm on 31st December or when all 500 tickets are sold, whichever comes first. Late entries will not be accepted.

  5. Number of Entries
    A maximum of 500 tickets will be sold. Each entry will be allocated a unique number. Participants may purchase multiple tickets to increase their chances of winning. The odds of winning are 1/100 due to 5 prizes being available.

  6. Prizes
    Five (5) winners will each win a paddleboard from our list of most popular models, subject to availability. Winners will be able to choose one paddleboard from the following models: 1. The Pace 10'6" + an ISOBATH. The prize is non-transferable, non-refundable, and no cash alternative will be provided.

  7. Winner Selection
    Winners will be selected at random from all valid entries using a computer-generated process. The draw will take place at 2:00pm on 11th October, and winners will be notified by email and/or phone within 24 hours.

  8. Claiming the Prize
    Winners must claim their prize within 7 days of being notified. If a winner does not claim their prize, or if they cannot be contacted within this time, the prize will be forfeited, and a new winner will be drawn.

  9. Publicity
    By entering, participants agree to have their name, photo, and general location (e.g., city or county) published on our website and social media channels if they are a winner, for promotional purposes related to the competition.

  10. Data Protection
    Any personal data collected during the competition will be used solely for the purposes of administering this competition and will be processed in line with our privacy policy. You can view our privacy policy at [insert link].

  11. Postal Entries
    Postal entries must be received by 12:00pm on 11th October. We cannot accept responsibility for any postal entries lost, delayed, or damaged in transit.

  12. Changes to the Competition
    The promoter reserves the right to cancel, amend, or extend the competition in the event of circumstances beyond its control, such as insufficient entries.

  13. Governing Law
    These terms and conditions are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Video Review Promotion: Terms and Conditions

1. Promotion Overview: Aquaplanet is running a promotion inviting customers to submit video reviews showcasing their experience using Aquaplanet or Hurley paddle boards and expressing their love for paddle boarding. Participants have the chance to earn up to £100 in store credit in exchange for their video submission.

2. Submission Requirements: Participants must create and submit a video review demonstrating their use of Aquaplanet or Hurley paddle boards and explaining why they enjoy paddle boarding. Videos should be clear, engaging, and no longer than 10 minutes. Submissions must be received by Aquaplanet no later than 7th July 2024.

3. Compensation: a. Eligible participants whose videos are selected by Aquaplanet will receive store credit up to a maximum of £100. The amount of store credit awarded will be determined at the sole discretion of Aquaplanet. b. Store credit will be issued electronically and can be redeemed for purchases on the Aquaplanet website or authorized retail partners.

4. Rights and Permissions: a. By submitting a video, participants grant Aquaplanet the unrestricted right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display the video content worldwide in any media. b. Aquaplanet reserves the right to select which videos will be used for promotional purposes and to decline to use any video without providing reason or compensation. c. Participants agree that no additional compensation will be provided beyond the store credit offered, even if their video is used for marketing purposes. d. Aquaplanet may request written permission from participants to use their video content for marketing activities. Refusal to provide such permission may result in disqualification from receiving store credit.

5. Eligibility: a. This promotion is open to residents of UK who are aged 18 years or older. b. Employees of Aquaplanet and their immediate family members are not eligible to participate.

6. Confidentiality and Privacy: a. Personal information collected during the submission process will be used solely for administering this promotion and will not be shared with third parties, except as necessary for the fulfillment of prizes.

7. Disclaimers: a. Aquaplanet reserves the right to cancel, terminate, modify, or suspend the promotion should any unforeseen circumstances arise that affect its administration, security, or fairness. b. By participating in this promotion, participants agree to abide by these terms and conditions and the decisions of Aquaplanet, which are final and binding in all matters related to the promotion.
